In Washington, Reuters reports U.S. Court of Appeals for the Fifth Circuit has ruled against the Environmental Protection Agency’s decision in July to reject nearly all of the pending small refinery exceptions for biofuel blending under the Renewable Fuels Act, saying the EPA’s decision was “impermissibly retroactive; contrary to law; and counter to the record evidence”. Ergon, Calumet Shreveport and Placid were amongst the refiners who sue the EPA for having rejected their SRE applications.
